LEMU GLOBAL LIMITED (hereinafter “Company” or “Lemu Global”, indistinctly) takes very seriously the protection of the privacy and personal data of its users. Therefore, the Users’ personal information is safely kept and processed with extreme care and in compliance with current legal provisions on personal data protection.

This Privacy Policy rules the access and use of the services provided by this website/application (hereinafter, the “Website/App” or “Platform”), owned by the Company, provided to Users interested on the contents offered by the Website/App. This Policy applies to personal data collected by the Company of the users through the Website/App or any other media, owned or used by Lemu Global, and connected to this Privacy Policy. 

All references within this document to terms with initial capital letters shall hold identical definitions as stipulated in the Terms and Conditions of Use. 

Please read carefully this Privacy Policy and, before using the Website/App, expressly accept the conditions indicated below on the section shown on the Website/App for this matter.

Definitions

  • Personal Data: data regarding a living person that could be identified by using this information (or with this and other information that we hold or that we could be holding).
  • Usage Data: data automatically collected, generated by the use of the Service or by the Service’s infrastructure (i.e., the period of navigation on a certain page or mobile application).
  • Cookies: Small files stored on the User’s device (computer or mobile device) to collect and store information about them, such as, by way of illustration only, their past preferences and how they have previously interacted with the Website/App.
  • Data Controller: A person or entity (as individuals or with other persons) that determines the purposes for processing and the form in which any Personal Data is or will be processed. For the purposes of this Privacy Policy, we are the Data Controllers of your Personal Data.
  • Data Processor (or Service Providers): Any person or entity processing data on behalf of the Data Controller. We can use the services supplied by different Service Providers in order to process your data more efficiently.

General aspects

Lemu Global will request information to the User at the moment of signing up to the Platform. The minimum information that may be requested, mandatory to become a Registered User, includes full name, email, and the creation of a password, where applicable, in case of an individual.

In case of an entity, it would need to sign up with the company name, its address, and the full name, email, and ID document of its legal representative. This information may be provided through the different available options to login to the Platform.

In the case of Unregistered Users, Lemu Global will request the necessary information in order to process payments and purchases made by them on the Platform. This information is mandatory for the processing of purchases and corresponds to name, surname, email and billing address.

The User’s Profile is created with both mandatory and optional information. 

Lemu Global may request Users to provide certain minimum mandatory information, which will be reviewed from time  to time, required for the User to use the Services, that may include: full name, ID number, sex, birth date, email, password, and nickname.

Regarding non-mandatory additional information, the Platform may have the feature on its configuration to allow the User to decide how much information will be provided to Lemu Global and, at the same time, if such information can be publicly accessible on the Platform or if it should remain private. The User understands that publishing their information is under its own liability.

Lemu Global reserves the right to delete any information published by the User that Lemu Global considers offensive, discriminatory, harassing, slanderous, threatening, obscene, and pornographic, or any other information that openly is a violation of morals, good manners or public order; or that Lemu Global itself determines as unnecessary for the Website/App’s purposes.

Collection of user information

Lemu Global may collect information about the User directly from the moment of their registration on the Platform, when they purchase services as an Unregistered User, and/or when the User makes queries through its Contact section or through the email support@le.mu or other emails defined by Lemu Global. Lemu Global may collect the User’s information periodically, i.e. each time that the User updates their personal information on their User Profile and each time that they contact Lemu Global. Additionally, Lemu Global may obtain the User information from external sources to be able to offer the User the services requested on the Platform. The User understands that Lemu Global may establish future new mechanisms to obtain the User’s information, so the Platform Users can have as much information as possible, which contributes to making responsible and informed decisions.

Access to information available on the Website/App

Lemu Global will provide Registered Users, and Unregistered Users, where applicable, access to legal documents related to services provided on the Platform and information related to transactions on the Platform. The Registered User may review their information at any time, available on the Platform’s “User Profile” section. The User can update their personal information on their Profile as many times as required, provided the developments on the Platform allow it.

Usage of User Information

Lemu Global will use the User information to facilitate the transactions performed on the Platform.
The User declares knowing and accepting that the use of their information as detailed above is necessary for the Platform’s proper functioning, so in case it is not truthful, available, complete or updated, Lemu Global may suspend or terminate, at its own discretion, the User access to the Platform.

Recommendations for users

Username

The User may choose the username for the Platform at the moment of registering on the Platform. However, when registered through another available method, their User name will correspond to that of the other method.

Personal Identification Information

On the User Profile there will never appear visibly the User’s ID document nor their contact information. If the User publishes such information on the free text fields of the User Profile, the User understands that performing such action is at their own risk and responsibility. Notwithstanding the above, Lemu Global may deactivate the User account on the Platform if it identifies that a User is performing actions that could affect their safety. Likewise, Lemu Global recommends the User to protect their username and password, always keeping them in private and not sharing such information, which should always be managed in a personal and private way.

The username and password, if applicable, required for authentication on the Platform, must always be of exclusive use of the owner of the User account. If the User shares their username and password, where applicable, with third parties, the User understands that this action is performed under their own risk and responsibility.

Lemu Global will provide a mechanism so the User can recover their password in case of forgetting it. Lemu Global will never request the User their password through any means other than the moment of authenticating on the Platform. 

Password

For security, we recommend the User to change their password, in case of having one, frequently. The User must not share the password with third parties, because it is for the exclusive use of the User account holder. 

Platform

We recommend the User to login into the Platform only on the url: https://le.mu/ or the App Lemu Earth.

Access of Minors to the Platform

The Website/App target is not minors. You should activate parental control to prevent and control the access of minors to the Internet, and inform minors about aspects related to safety and security while using the Internet. 

Security Measures

Keep on your device antivirus software installed and duly updated, ensuring that your device is free of malware, as well as of spyware apps that may put at risk your Internet browsing and put in danger the information stored in the device.

User Account on the Platform and information backup

Each Registered User on the Platform will have their own User account, which can be accessed once authenticated on the Platform by indicating their Username and password, where applicable. The User may have a User Profile, where they can publish information about them. On the User Profile, each User will decide which information to post for other Users and which information to keep private. Lemu Global reserves the right to restrict certain fields from being visible for other Users.

Acceptance of Privacy Policy and its modifications

Upon accessing the Website/App, Users will be required to manifest their explicit acceptance, as delineated in the aforementioned section, regarding this Privacy Policy. This action signifies the User's explicit consent to the automated processing of the furnished Personal Data.

However, the User may revoke, at any time, the given consent, giving notice to Lemu Global at support@le.mu Lemu Global, reserves the right to revise its Privacy Policy at any time it deems appropriate, in which case we will duly inform Users so that they can provide their consent to the modifications.

Personal data processing and purposes of such processing

Lemu Global undertakes that the Personal Data requested will be strictly necessary to carry out the service offered. The User will be informed when the provision of certain data is mandatory for the performance of certain services.

Processing of Personal Data by Lemu Global

In compliance with the provisions of the pertinent regulations, Lemu Global hereby informs Users that the data collected through any data collection form included on the Website/App will be incorporated into an automated database of Personal Data, for which the Company is responsible. All fields of the forms must be completed (unless expressly stated otherwise on the form), so that the omission of any of them will imply the impossibility of fulfilling the requirement to provide the User's service.

The Personal Data of the Users may be used by the Company to provide the services requested, as well as to send them commercial communications or Company’s advertising. 

Forwarding of commercial communications on behalf of third parties

In accordance with the corresponding regulations on Consumer Rights Protection, the Personal Data of Users may be used by the Company to send commercial and promotional communications, acting on its own behalf. This use of Users' Personal Data may be suspended at the User's request to the aforementioned e-mail address.

Processing of data for the purpose of executing contracts to which the data subject is a party

In compliance with the provisions of the relevant regulations, the Personal Data of the User may be used by the Company to fulfill our contractual obligations, as well as to enforce compliance with the contractual obligations of the User. This includes, but is not limited to, storing information regarding the User's means of payment, and using the User’s contact information to send receipt of payment and purchase orders.

Processing of data for statistical and segmentation purposes

Through the express acceptance given when entering the Website/App, the User consents to the processing of their data for the elaboration of profiles, as well as for the segmentation of their data. We inform you that for this purpose we use Google’s tool Google Analytics Demographic and Interest Reporting. The aforementioned processing may be for the purpose of both the analysis and statistics to know the traffic and use of the Website/App by the Users, as well as the determination of their preferences for sending promotional information from sponsors or third party companies according to the interests of the Users.

Particularly, by accepting this Privacy Policy, the User consents that their data may be associated with online identifiers provided by their devices, applications, tools and protocols, such as the Internet protocol addresses, session identifiers in the form of cookies, or other identifiers. This may leave traces that, in particular, when combined with unique identifiers and other data received by servers, can be used to profile and identify individuals. In this sense, by expressly accepting this Privacy Policy, the User explicitly consents that their data may be used for profiling and segmentation purposes by Lemu Global and its affiliated companies. If you disagree with statistical and segmentation processing, we will ask you to delete your Account and stop using the Services.

Accuracy and quality of data

The User guarantees that the Personal Data provided are accurate and truthful, and is responsible for communicating to the Company any changes thereto. The User will be responsible, in any case, for the veracity of the data provided, and the Company reserves the right to exclude from the registered services any User who has provided false data, without prejudice to any other actions that may be applicable by law.

Data storage

Lemu Global will retain your Personal Data only as long as necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to provide our services and comply with our legal obligations (for example, if we are required to retain your data to comply with applicable law), resolve disputes, and enforce our policies and legal agreements.

Access, Rectification, Deletion and Objection Rights

The User may exercise, at any time, their rights of Access, Rectification, Deletion and Objection Rights to the processing of their data at the email address support@le.mu 

To exercise these rights, it will be necessary to attach evidence of your ID document, or any other valid means to prove your identity.

Data transfer

Your information, including Personal Data, may be transferred to -and maintained on- computers located outside your state, province, country or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction.

If you are located outside of the United Kingdom and choose to provide us with information, please note that we transfer the data, including Personal Data, to the United States and process it there.
Your acceptance of this Privacy Policy followed by your submission of this information represents your agreement to such transfer.

Lemu Global will take all reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data to any other organization or country will take place unless there are adequate controls in place including the security of your data and other personal information.

Data disclossing

Company reorganisation

If Lemu Global is involved in a merger, acquisition or sale of assets, your Personal Data may be transferred. We will notify you before transferring your Personal Data to require your consent to do so, and before it becomes subject to a different Privacy Policy, which must also be accepted by Users.

Legal obligations

Lemu Global may disclose your Personal Data in good faith when such action is necessary for the following purposes:

  • To comply with a legal obligation
  • Prevent or investigate possible breaches in connection with the Website/App
  • Protect the personal safety of users of the Website/App

Consent

The User declares to have been informed of the conditions relating to the protection of their Personal Data, accepting and consenting to the processing of it by the Company, in the manner and for the purposes indicated in this Privacy Policy.

Users’ Public Information

Sharing Information

Sharing information provided by the User to Lemu Global with other Users of the Platform is a matter of the User's individual volition and is undertaken at their own peril and accountability. Lemu Global shall disseminate Users' information in the ensuing circumstances:

  1. Registered Users may access other Users’ information only when they have chosen to publish their information for other Users.
  2. Lemu Global may share certain information of the User with third parties related with the service the User has used, as well as with third parties that are Lemu Global suppliers -such as massive email sending companies, among others- with the objective of providing a better service to the User.
  3. Lemu Global will share the User’s information according to what is allowed and/or required by law or by judicial and/or auditing authorities that require such information from Lemu Global.
  4. Lemu Global will not sell or rent to third parties the information provided by the User to Lemu Global with marketing and/or commercial purposes.

User’s Information Protection

Technological Aspects

Lemu Global uses physical and electronic mechanisms, among procedures and practices that aims to keep the Users’ information. Among these mechanisms, Lemu Global uses data encrypting technologies and other technologies to protect the information the User provides to the Website/App, stored on the Platform’s databases.

Lemu Global uses firewalls and other technologies with security purposes to protect the servers from third-party attacks and/or hacks. Lemu Global performs security tests frequently to ensure an environment as safe as possible for its Users.

Information Storage

Lemu Global stores the information of its Users collected through the Platform and other data collection mechanisms on its databases, so it can provide an adequate service to the Registered Users, with the purpose of ensuring the data integrity and preventing third-party frauds. 

Notwithstanding the above, the User hereby declares to understand that the Internet security measures are not impenetrable.

Communications generated on the Website/App

Lemu Global will send notifications to the User to its email and/or through Lemu Global’s internal messaging system. These notifications will be related to the use of the Services offered on the Platform. Lemu Global retains the right to abstain from dispatching all communications and/or notifications to the User via email. Lemu Global may communicate certain information only by the Website/App’s internal messaging system, under its own discretion.

Affidavit

The User hereby acknowledges that it has electronically read and understood the full content of the Privacy Policy, and that by clicking on the "I accept" button below, it expressly, unequivocally and irrevocably accepts the Platform’s Privacy Policy. The electronic document of the Privacy Policy will be filed in Lemu Global's database, and will be accessible to the User in its User Profile. In the event that the User needs to identify and correct errors in the submission or in its data, it may contact Lemu Global by the means indicated above.
